1. Nature of the Services

HFITNESS provides a self-directed educational and wellness platform designed to support general pelvic floor and bladder health through educational content, exercise programs, and user-controlled tracking tools.

HFITNESS is not a healthcare provider, and the Services do not constitute medical care.

2. No Medical Care or Physician-Patient Relationship

HFITNESS does not provide medical advice, diagnosis, or treatment.

Use of the Services does not create a physician-patient or healthcare provider relationship between you and HFITNESS or any of its personnel.

All content provided through the Services is for general educational and informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. You should always consult a qualified healthcare provider before starting any exercise or health program.

3. User Responsibility and Assumption of Risk

Participation in any exercise or wellness program involves inherent risks, including but not limited to injury, illness, or other adverse outcomes.

By using the Services, you:

• Acknowledge these risks
• Voluntarily assume full responsibility for your participation
• Agree that you are solely responsible for your health decisions

You agree to consult a physician prior to participating in the Services, especially if you have a medical condition, recent surgery, or other health concerns.

4. User-Generated Health Data and Tracking Tools

HFITNESS may provide tools that allow you to record, store, and track personal information, including health-related data such as symptoms, activity levels, or other wellness metrics (e.g., bladder diary features) ("User Data").

You acknowledge and agree that:

• All such data is entered and controlled by you
• HFITNESS does not monitor, review, interpret, or act upon this data
• HFITNESS does not provide medical advice or recommendations based on this data
• The data is provided solely for your personal informational and self-tracking purposes

You are solely responsible for how you interpret and use your User Data.

5. User-Directed Sharing of Information

The Services may include features that allow you to send or export your information (including User Data) to a third party, such as a healthcare provider.

By using such features, you acknowledge and agree:

• You are solely responsible for initiating and directing any transmission
• HFITNESS does not control, review, or verify the content of such communications
• HFITNESS does not establish or facilitate any relationship between you and any provider
• Transmission methods (including email) may not be secure
• HFITNESS is not responsible for the security, delivery, or use of any transmitted information

6. HIPAA and Health Information

HFITNESS is not a Covered Entity or Business Associate as defined under the Health Insurance Portability and Accountability Act ("HIPAA").

Information you provide to HFITNESS is not considered Protected Health Information (PHI) under HIPAA as maintained by HFITNESS.

HFITNESS does not provide services on behalf of healthcare providers and does not receive or process medical information under HIPAA-regulated relationships.

7. No Monitoring or Clinical Intervention

HFITNESS does not:

• Monitor user activity or data for medical purposes
• Provide alerts, diagnoses, or clinical oversight
• Respond to user data with medical guidance

You should not rely on the Services for medical monitoring or clinical decision-making.

8. No Guarantee of Results

While HFITNESS may reference research, educational principles, or general outcomes:

• Individual results will vary
• No specific outcomes are guaranteed
• The Services do not constitute treatment for any medical condition

9. Privacy

Your use of the Services is also governed by our Privacy Policy. By using the Services, you agree to the collection and use of information as described in that policy.

10. Payments and Subscriptions

HFITNESS offers subscription-based and other paid services. By purchasing a subscription, you authorize recurring billing as described at the time of purchase. Subscriptions continue until canceled by you.

No refunds will be provided except as expressly stated.

11. Intellectual Property

All content, materials, and features of the Services are owned by HFITNESS or its licensors and are protected by applicable intellectual property laws.

Unless otherwise noted, the design and content features on the Site and Services, including without limitation, information and other materials, illustrations, product layout and design, icons, navigational buttons, images, artwork, graphics, photography, text, data, audio sound, software, URLs, and the like, as well as the selection, assembly and arrangement thereof (collectively, the "Site Information"), are owned by HFITNESS or its affiliates, if any, or are licensed by HFITNESS from third parties. The Site and Services, as a whole and in part, are protected by copyright, trademark, service mark, trade name, and other intellectual property and proprietary rights, and all other applicable rights are reserved.

Unless otherwise provided through any other applicable terms and conditions to which you agree, no portion of the Site, Services or Site Information may be reprinted, republished, modified, or distributed in any form without HFITNESS's express written permission. You may not, and these terms do not give you permission to, reproduce, reverse engineer, decompile, disassemble, modify, transmit, sell, distribute, license or create derivative works with respect to the Site, Services or any of the Site Information.

12. Acceptable Use

You agree not to misuse the Services or engage in unlawful or harmful behavior.

13. Disclaimer of Warranties

The Services are provided "as is" and without warranties of any kind, whether express or implied. The Site, Services or Site Information may contain errors or omissions, or may be out of date. The Site, Services or Site Information may, without prior notice, change, be deleted or updated at any time.

14. Limitation of Liability

To the fullest extent permitted by law, HFITNESS shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Services. You acknowledge that there are inherent risks of injury with any physical activity and nutrition program and hereby release HFITNESS LLC and all of its employees, directors, officers, representatives, and other parties involved in the creation and distribution of this content thereon, including, but not limited to physical injury, illness, death, loss of profits, loss of data, whether in an action in contract, tort (including but not limited to negligence) or otherwise.

15. Release and Indemnification

You agree to indemnify, defend and hold HFITNESS and its affiliates, if any, officers, directors, employees and agents, harmless from and against any and all claims, demands, actions, costs, liabilities, losses and damages of any kind (including attorney's fees) arising out of your use of the Services, your User Data, or your violation of these Terms.

16. Termination

HFITNESS may suspend or terminate your access to the Services at any time.

17. Policy Regarding Use of HFITNESS Trademarks

The trademarks, logos, and service marks ("Marks") displayed on the Site are registered trademarks of their respective owners, are the property of their respective owners, and/or are protected by U.S. and international trademark laws and/or common law. Their uses are restricted to programs, events, products or services that HFITNESS sponsors or with which we are otherwise affiliated. HFITNESS's trademarks may not be used for personal financial gain. Use of the Marks is prohibited without HFITNESS's express written consent except as permitted by applicable laws. Nothing contained on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use the Marks without HFITNESS's express written consent.

18. The Security of the Site

HFITNESS maintains reasonable safeguards and personnel policies that are designed to guard the Site, the Services, our systems and user information. For example, for the security of your online visit to the Site, HFITNESS may make use of firewall barriers, encryption techniques and/or authentication procedures.

Unfortunately, no data transmission over the Internet can be guaranteed to be absolutely secure. As a result, while HFITNESS strives to protect your information, it cannot ensure or warrant the security of any content you transmit to us, and you do so at your own risk. In the event of a breach of the confidentiality or security of your personal information, HFITNESS will notify you as necessary so you can take appropriate protective steps. Unless you indicate otherwise, we may notify you under such circumstances using the email address you provided to us when you registered with the Site.

When you visit the Site, use the Services or send emails to HFITNESS, you are communicating with us electronically. You consent to receive communications from HFITNESS electronically. These Terms are governed by the laws of the State of Delaware.
